Rules and Regulations

The following rules and regulations adopted by the Board of Directors of the Forest Hill Cemetery Association at the Annual Meeting on the third Wednesday of April, 1992 supercede all previous rules and regulations, and shall become a part of the contract between the Association and the cemetery lot owners. The term cemetery as used herein refers to the Forest Hill Cemetery Association

The name of the association is the Forest Hill Cemetery Association and the grounds shall be known as the Forest Hill Cemetery. The association shall be composed of members who are lot owners by purchase or descent of burial lots in the cemetery, but no one shall become a member until the lot has been paid for in full by himself or the purchaser from whom he inherits. All members shall be entitled to vote in person or by proxy at all meetings of the association upon any question coming before said meeting. When several members have become joint owners of a family lot by descent, they, or a majority of them may designate one of their family to vote in person or by proxy at all meetings, provided proof of such title by descent shall have been filed with the association.

  1. All lots shall be subject to the laws of the State of South Dakota and the Forest Hill Cemetery Association.
  2. Lot owners shall not allow any burials or any transfers or sale of any lot without the consent in writing of the Cemetery Association Board or Directors.
  3. Lot enclosure or any kind is prohibited.
  4. The association distinctly disclaims all responsibility for loss or damages from causes beyond its control and especially from damages caused by the elements, an act of God, common enemy, thieves, vandals, strikers, malicious makers, explosions, unavoidable accidents, invasions, insurrections, riots or order of any military or civil authority, whether the damage is direct or collateral.
  5. The cemetery will be open each day.
  6. An order shall be required from the lot owner whenever a burial is to be made.
  7. No disinterment shall be allowed without permission being first obtained from the Board of Directors.
  8. The Association shall be given 36 hours notice for the opening and closing and preparation of the grave prior to interment. Burials are under the direction and authority of the President and Secretary of the Association.
  9. No monumental work may be placed on any lot for which any portion of the purchase price remains unpaid. The Association reserves the right to refuse to permit delivery within the grounds until the ground and avenues are thoroughly settled and in good condition. The Association reserves the right to regulate all work done in the Cemetery.
  10. The owner of each lot shall have the right to purchase any size proper memorial of granite, marble, or bronze. All monuments shall be placed at the head (west end) of the grave. Gravestone base to reach at least 8 inches beyond the stone at ground level.
  11. No headstone or marker shall be placed in the middle of the gravesite. All monuments must be placed in line with the marker on the right or left. All urns or planters must be placed on either side or back of the monument.
  12. Annuals must be planted in urns or planters. Sod must not be dug up or disturbed. The Board of Directors has the control of trees, shrubs or flowers growing within the cemetery enclosure whether planted by the lot owner or otherwise, and the right of removal of the same when it considers such removal advisable.
  13. Artificial flowers and wreathes are not permitted after June 30th. All such flowers will be removed by the custodian after that date. When flowers, wreathes, emblems, etc. used at funerals or placed on graves at other times become faded or unsightly, they will be removed and disposed or properly.
  14. Perpetual care shall mean: the care and cutting of grass, keeping lots in order and constructing, improving, repairing, maintaining roadways, walks and drives and anything for the beautification of the Cemetery. The lot owner will be responsible for the planting of grass or the laying of sod on the gravesite. Mounding of graves will not be permitted.
  15. A complete record of all burials and a map of the location of every grave shall be placed on record by the Secretary of the Association.
  16. The Association may, from time to time, make such rules and regulations for the governing of the grounds as they deem necessary to secure and promote the general objectives of the Association.
  17. The Cemetery Association will purchase lots not used by lot owners.
